1. Client Rights and Obligations

At New Horizon Accountants, we are committed to keeping our clients fully informed about their rights and obligations under the Australian taxation system. This includes your entitlement to fair treatment, transparency in service delivery, and clarity around the services we provide.

As a client, you have the right to:

  • Access accurate and timely information about your tax position.

  • Expect that your data will be handled with strict confidentiality and integrity.

  • Receive services that comply with the standards and regulations set by the Tax Practitioners Board (TPB) and the Australian Taxation Office (ATO).

As a registered tax agent, we also ensure that our clients may benefit from safe harbour provisions under the Taxation Administration Act 1953. This means that if you provide us with all necessary information and we make a mistake, you may be protected from administrative penalties from the ATO. We will always inform you when these provisions apply to your situation.

2. Complaints and Dispute Resolution

We strive to provide exceptional service and build lasting relationships based on trust, but we understand that concerns may arise from time to time. If you are dissatisfied with any aspect of our service, we encourage you to:

  1. Contact us directly by phone or email to raise your concerns. We will respond promptly and seek to resolve the issue as quickly and fairly as possible.

  2. If your complaint is not resolved to your satisfaction, you may lodge a formal complaint with the Tax Practitioners Board (TPB), the national body responsible for the registration and regulation of tax practitioners.

3. Privacy and Confidentiality

5. Client Verification Statement

In accordance with TPB’s guidelines on fraud prevention and client due diligence, we have implemented robust client identity verification protocols. These procedures ensure we can:

  • Confirm the legitimacy of each client engagement.

  • Prevent unauthorised access to your financial and personal information.

  • Comply with anti-fraud, anti-money laundering, and cybersecurity best practices.

Verification may include requests for identification documents, secure digital signatures, and additional authentication steps where required.

6. Digital Services and Online Security

To ensure accurate, secure, and streamlined service delivery, we use official ATO digital platforms, including:

  • Online Services for Agents – for lodging returns, accessing your tax records, and managing your obligations efficiently.

  • Relationship Authorisation Manager (RAM) – to securely link our services with your tax profile and manage permissions for business clients.

These platforms help ensure that your tax affairs are handled professionally and with full transparency, using the latest in government-authorised technology.

7. Performance of the Services

New Horizon Accountants will provide the services outlined in the Fee Engagement Letter and will use all reasonable commercial efforts to deliver these services efficiently, promptly, and with the level of skill and care expected of a qualified professional.

Please note that we have not audited or independently verified any of the accounting records or information you have supplied. While we rely on the materials you provide, we are not responsible for verifying their accuracy or completeness.

To enable us to deliver our services effectively, your timely cooperation is essential. This includes:

a) Providing New Horizon Accountants with all accurate and complete information and documents (including bank records) as reasonably required for us to perform our services.

b) Facilitating access to any relevant third parties, where necessary; and

c) Ensuring that any computer systems or files you provide to us are backed up, secure, and free from viruses.

We also rely on you to inform us promptly of any changes to the original information provided, as this may impact the advice or services we offer.

8. Electronic Communications

We will communicate with you electronically, including sending you Commercial Electronic Messages (as that term is defined in the SPAM Act 2003). You consent to us sending Electronic Communications to you.

Electronically transmitted information cannot be guaranteed to be secure or virus or error free and consequently such information could be intercepted, corrupted, lost, destroyed, arrive late or incomplete or otherwise be adversely affected or unsafe to use. We will not be liable to you in respect of any error, omission or loss of confidentiality arising from or in connection with the electronic communication of information to you.

9.Previous Accountant (if applicable)

As a matter of professional courtesy, and in line with the requirements of the CPA Australia, we will need to inform your previous accountant that we have been engaged by you as your new accountant and to receive from them any outstanding matters and files. You may refuse to provide this information but in doing it may cause problems in the efficient transfer of your files.

10. Ongoing Application of these Terms Of Service

You acknowledge and agree that these Terms of Service apply to all work to be performed by us on your behalf unless mutually agreed in writing.

Should you not sign these Terms yet nonetheless continue to instruct us to act on your behalf, you shall be deemed to have accepted these Terms as applying to that work.
